Rollshayes Farmhouse Booking Conditions
1 The contract is between Mrs J.C.Hayes ("the Owner") and
the person signing the Booking Form ("the Hirer"), who shall
be over 18 years of age, for the hire of Rollshayes Farmhouse and
its contents ("the Property") for a holiday ("the Holiday")
within the meaning of the Rent Act 1977. The contract is effective
on the posting of written confirmation by the Owner. The Owner reserves
the right to refuse any booking, in which case any payment made shall
be refunded.
2 The Property is available to the Hirer from 3.00pm on the first
day of the Holiday until 10.00am on the last day. Only the persons
named in the Booking Form or later substituted or added with the Owner's
consent ("the Hire Party"), which must include the Hirer,
will be admitted and pets will not be admitted except by prior arrangement.
3 Booking Forms posted 56 days or less before the Holiday's commencement
must be sent with payment of the Rental Charge and Security Deposit.
Otherwise Booking Forms must be sent with payment of the Rental Deposit,
and the balance of the Rental Charge and Security Deposit are due
56 days before Commencement. Non-payment shall be treated as cancellation
as in 4).
4 Cancellations must be in writing. The Rental Deposit and Charge
paid and payable shall be forfeited by the Hirer. Both parties must
attempt to relet the property and if either is successful the Owner
will refund the amount paid by the Hirer less any expenses or
discount attributable to the re-letting. The Owner reserves the right
of refusal over lettings proposed by the Hirer but this will not
be exercised unreasonably.
5 The Hirer is advised to purchase cancellation insurance policy.
6 If the Property is made unavailable for any reason outside the Owner's
control the Hirer will be notified as soon as possible, the Owner will
refund all payments made within 7 days thereof and no member of the
Hire Party will have any further claim against the Owner.
7 The Hirer undertakes as follows:
To take reasonable care of the Property during the Holiday, to leave
it clean and tidy and to pay for any loss, breakage or damage except
that arising through normal wear and tear.
To settle additional charges for grocery orders and to return the
key on departure.
Not to part with possession of the Property or share it, except with
members of the Hire Party, and to
permit the Owner or her agent reasonable access.
Not to leave pets unattended in the property.
8 The Owner will return the Security Deposit 14 days after the
end of the Holiday subject to any
deduction for any outstanding liability.
9 The Owner is not liable to any member of the Hire Party for any
loss, damage, injury or illness
sustained by their person or property, including pets.
10 The Hirer certifies in signing the Booking Form that he or she
is authorised to agree to these Booking Conditions on behalf of the
Hire Party.
11 This contract is subject to English law. Any dispute shall be
referred to a single arbitrator, to be agreed, or in default of such
agreement, to the President for the time being of the Law Society
or Institute of Arbitrators. In either case such arbitration would
be subject to the provisions of the Arbitration Act 1950 or any statutory
modification thereof for the time being in force.
